Terms Of Service

1. Ownership and services purchased

• The individual or entity set out in our records as the primary billing contact shall be the owner of the account.

2. Payments and billing

• We reserves the right to charge Customers via internet payment gateways or bank deposit. All fees are billed and are subject to change with thirty (30) days prior notice to you.
• Your “Billing Term” is the period of time you have chosen to receive bills for the Services. For example, your Billing Term may be monthly, quarterly, annually, biennially or triennially.
• WebsNP is only able to automatically collect payment from customers through third-party online payment gateways. All other payments must be made through cheque or cash-deposit at a designated bank within or outside Nepal. It is your obligation to ensure that recurring fees are paid on their due date.
• As a customer of WebsNP, it is your responsibility to ensure that all billing information on file with WebsNP is accurate prior to making any payment online or offline. You are solely responsible for any and all fees charged to your payment method by the issuer, bank, or financial institution including, but not limited to, membership, overdraft, insufficient funds and over the credit limit fees. You remain liable for any charge incured on any card or bank account used to purchase any of our service.

3. Cancellation

• Cancellations request must be submitted from the authorized email, Support ticket or via the request cancellation link. All cancellations must be completed (30) Days prior to service renewal date.

4. Money back guarantee; refunds

• Requests for refunds are governed by our Money back Guarantee which is 7 days or 10 % of bandwidth usage (25GB when unlimited subscription) (whichever comes first) for all Hosting, Virtual, Cloud, Smart and Dedicated Servers. Custom Orders and setup fees are not eligible for refund. Refunds are limited to one (1) service per customer account. Customers are defined by company, email or billing identifier. Account credits are nontransferable and may not be exchanged for currency of any kind..

4. Payment Disputes.

• Client agrees that invoices must be disputed before the invoice due date. Invoices not paid on their respective due dates may result in service suspension or service termination of service. As a result, the WEBS NP is not liable for any service interruption that occurs as a result of any invoice disputed on or after the invoice due date. In the event that an invoice dispute is initated before an invoice due date and the dispute is still not resolved by the invoice due date, the remaining undisputed items on the invoice should still be paid on or before the invoice due date. Client agrees that disputing a payment made to the WEBS NP by means of initiating a credit card chargeback, PayPal reversal, reversal request through Google Checkout, or using any other third party resource to reverse a payment will result in full and immediate account termination.

5. Examples of unacceptable material on dedicated servers include:

• Pirated Software / Warez, Escrow, High-Yield Interest Programs (HYIP) or related sites, Investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, hate sites, hacker focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forums and or websites that distribute or link to warez content are prohibited.
• WebsNP services, including all related equipment, networks and network devices are provided only for authorized customer use. WebsNP systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of WebsNP system(s) constitutes consent to monitoring for these purposes.
• We reserve the right to refuse service to anyone. Any material that, in our judgment, is obscene, threatening, illegal, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
• Failure to respond to email from our abuse department within 24 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via troubleticket/email and will have a response within 24 hours. The reactivation of a server may demands a reactivation fee of at least 30.00 USD. Please respond in due time to save these expenses.
• If in doubt regarding the acceptability of your site or service, please contact us at support@WebsNP.com and we will be happy to assist you.
• Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography:
• Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
• Resellers: we will suspend the site in question and will notify you so you may terminate the account.
• Direct customers: Your services will be suspended with or without notice.
• Violations will be reported to the appropriate law enforcement agency.
• It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

6. Anti-spam policy

• In the past several years, the Internet has exploded with commercial activity. In particular, “spam” has proven to be a major problem for many of our customers and the Internet at large. Spam is a common slang term referring to the sending of unsolicited email, instant messaging, or other communication to a large group of people at once. Variations on this practice include off topic (and usually promotional) messages on bulletin boards, guestbooks, Usenet newsgroups, or chat rooms.
• Spam is strictly against ourTerms of Service, and will result in the immediate disablement without refund of any customers who are found to have used spam in conjunction with their WebsNP account.
• PHP Mail Function Disabled on Shared Hosting :While we have had the mail() function disabled on our shared servers for a length of time, now and then the question arises as to why mail cannot be sent via their account using the basic mail() PHP function. The reason being is because, as the error details, the mail() function has been disabled because we have experienced a lot of spam and other unsolicited mail being sent and with better and more robust solutions being available to send mail, we had previously made the decision to disable the mail() function on our shared servers. This will help your mail going to spam too.As a courtesy to customers, You can create email accounts from cPanel and use mail function with valid username password, hostname and port. You also can install SMTP Mail plugins like Mailbank, WP SMTP, for wordpress website. You can search for "Changing from PHP Mail to SMTP via WordPress"
  Of course, if you have a VPS, Cloud Server or Dedicated Server with us, it is your call as to whether you want the mail() function enabled or disabled; but on our shared servers, we have to make certain decisions for the benefit of the majority of our customers where hundreds of websites are hosted on one shared server.

7. Maintenance

• Routine maintenance and periodic system repairs, upgrades, and reconfigurations may result in temporary impairment or interruption in Service(s). As a result, WEBS NP does not guarantee continuous or uninterrupted Service(s) and reserves the right from time to time to temporarily reduce or suspend Service(s) without notice subject to the terms and conditions of the applicable SLA.
