The limits of what we promise about this website, our services and the outcomes you get from them.

In short

We stand behind our work through the guarantees in the Terms and Conditions and the credits in the SLA. What we cannot do is promise outcomes that depend on software we did not write, services we do not run, or decisions Google makes. This document draws that line.

1.Information on This Website

The content of websnp.com, including specifications, comparisons, guides, pricing pages and blog articles, is published for general information. We keep it accurate and current to the best of our ability, but we do not warrant that every page is complete, error-free or up to date at the moment you read it.

Nothing on this website is legal, financial, tax or professional advice. Where a decision matters to your business, take advice from someone qualified to give it.

Prices, specifications and promotional offers may change, and an obvious pricing or specification error does not oblige us to honour it. The terms that bind us are those confirmed on your invoice and order at the moment of purchase.

Where we link to an external site, we do so for convenience. We do not control it, we do not endorse it, and we are not responsible for its content, accuracy or privacy practices.

2.Services Provided As Is

Except for the express commitments we make in the Terms and Conditions and the Service Level Agreement, our services are provided on an "as is" and "as available" basis, to the fullest extent permitted by law.

We do not warrant that a service will be uninterrupted, error-free or entirely secure, that it will meet a requirement you have not told us about, or that every defect can be corrected. Complex systems fail sometimes. What we commit to is the uptime in the SLA, the credits when we miss it, and support that responds.

What we do stand behindThe uptime commitments and credits in the SLA, the money-back and cancellation rights in Section 4 of the Terms, and the delivery, revision and ownership commitments written into your project scope document. Those are contractual promises, not marketing.

3.Third-Party Software and Services

Much of what runs on your account is software we license or install rather than write: WordPress and its themes and plugins, WooCommerce, cPanel, Plesk, LiteSpeed, CloudLinux, Softaculous, payment gateways, SSL issuers, registries and registrars.

We keep our platform current and we help you when third-party software misbehaves, but we cannot warrant the fitness, security or continued availability of software written by others, and we are not liable for a vulnerability, a breaking change, a licence change or a discontinuation originating with the vendor.

Domain registrations are subject to the rules of the relevant registry and ICANN, including their eligibility, dispute and deletion policies. We act as your agent in submitting a registration; we do not control whether the registry accepts, holds or later suspends it.

4.Data, Backups and Recovery

Backups we take are a courtesy layer of protection, not a contracted data-recovery service, and they are not a substitute for backups you hold yourself.

  • We do not warrant that a backup exists, is complete, or can be restored for any particular account at any particular moment.
  • Backups may be unavailable where an account exceeds its inode or storage allocation, as described in the Acceptable Use Policy.
  • Data on accounts terminated for non-payment is destroyed as described in the Terms and Conditions and cannot be recovered afterwards.
  • We are not liable for data loss or corruption caused by your own software, an update you applied, a compromise of your credentials, or a deletion you performed.

Keep your own off-server copy of anything you cannot afford to lose. If you would rather not manage that yourself, ask us about a managed backup plan and we will contract for it properly.

5.Performance, Rankings and Business Outcomes

We build websites that are technically sound for search: semantic markup, clean structure, schema, sitemaps, fast mobile rendering and correctly configured analytics. That is the foundation ranking depends on, and it is what we contract to deliver.

We do not warrant any specific search ranking, traffic volume, conversion rate, sales figure or return on investment. Those depend on your market, your competition, your pricing, the content and links built after launch, and search engine algorithms that no agency controls and that change without notice. Anyone who guarantees you a position on Google is either misinformed or misleading you.

Where we quote a page speed score, it refers to the site as delivered and tested by us. Third-party scripts you add afterwards, such as tag managers, chat widgets, advertising pixels and heavy plugins, will change it.

6.Security and Communications

We harden our platform, patch it, monitor it and take security seriously, but no system connected to the internet can be guaranteed impenetrable. We do not warrant that our services or your site are immune to unauthorised access, and we are not liable for a compromise arising from your credentials, your code or software you installed.

Information transmitted over the internet, including email and form submissions, travels at your own risk. Do not send passwords, card numbers or other sensitive data by email; use the secure channels in your client area instead.

7.Limitation of Liability

To the fullest extent permitted by law, WebsNP is not liable for indirect, incidental, consequential, special, exemplary or punitive damages, including lost profits, lost revenue, lost business, lost goodwill or lost data, whether the claim is framed in contract, tort, negligence, breach of warranty or otherwise, and even if we were told such damage was possible.

Our maximum aggregate liability for any claim relating to a service is limited to the amount you actually paid us for that specific service in the three months preceding the event giving rise to the claim.

Nothing here excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

8.Consumer Rights and Jurisdiction

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations in this document apply only to the extent the law of that jurisdiction permits, and your statutory rights as a consumer are unaffected.

Consumers in some jurisdictions also hold a statutory right of withdrawal or revocation. Our contractual equivalent is set out in Section 4.4 of the Terms and Conditions, which applies to private accounts within 14 days of the contract start date.

By continuing to use this website and our services, you confirm that you consider the exclusions and limitations set out here to be reasonable. If you do not, the appropriate response is not to use them.
